Terms of service

Please read carefully!!
- By commissioning this Artist, Jarhinge, you agree to the following Terms of Service.

- Commissioned art, as well as any other art I make, may NOT be used to train AI for AI art or any other purposes
- All payment will be handled through PayPal.
- I DO NOT consent to my artwork being used to train AI models. Do not use my art for generative AI at any capacity.
- The Artist reserves the right to cancel and refund a commission at any time without explanation.
- Clients agree to pay upfront for the commission once the Artist has accepted their commission request before progress will be made on the artwork.
- If payment is not provided within 48 hours of the client's commission request being accepted, it may be considered cancelled.
- The Artist reserves the right to post the artwork
- All artwork commissioned is for personal use only. Even if fully paid for, making any profit using the artwork is prohibited. The client must ask and have explicit confirmation from the Artist to use the artwork in this way. There may be an added fee for such requests.
- Commissioned artwork may not be resold or used to make profit.
- Commissioned artwork may not be sold as/converted to an NFT or be otherwise used in relation to promote NFTs in any way.
- You may not claim/declare the commissioned artwork as your own work.
- If the client wishes to cancel a commission before it has been completed, a partial refund may be provided based on how much progress has been made. Clients agree that the Artist's decision on how much will be refunded is non-negotiable, as the time spent working on it is valuable.
- If a client cancels a commission before it is completed, the Artist holds all rights to the artwork and may be reused/sold by the Artist however they see fit.
- Partial refunds may be given if cancellation occurs. The amount of money refunded will depend on how much progress has been made on the artwork by the Artist.
- It is not possible to refund any commission if it has already been completed.
- A commission is considered "completed" when the client has approved of the artwork as being final. The Artist is not responsible for making changes to the artwork after it has been approved.
- The client must ask permission to make any edits to the final artwork.
- The client must provide clear visual reference of what they hold the rights to. If the client is found to have stolen the character/reference, the commission will be cancelled and refunded without warning (this only refers to stolen work from others. It does not include things such as in-game screenshots). The art may then be reused/resold by the Artist however they see fit.
- Any and all deadlines must be agreed on upfront along with payment. Shorter deadlines may resort in being charged a rush fee. However, if this deadline is unable to be met by the artist, the rush fee will be refunded.
- The client should only share/post the version of the commissioned artwork that has a clear watermark from the Artist. Due to theft, the Artist recommends to avoid posting the image at full size and/or without watermark to avoid theft.
- The Artist reserves the right to sell prints, make products, and otherwise make profit off of the commissioned artwork.
- The final artwork will be sent through E-mail unless another method has been discussed with the Artist prior to payment.
- The Artist is not responsible for keeping a safe file of the artwork. If the artwork is deleted or lost, the Artist is not responsible for providing the artwork again after the client has recieved their final artwork.
- Discussion of the content of the commission is to be kept off of Paypal and kept inside preferred communication method.

For ORIGINAL DESIGNS:
- The previous TOS mentioned above still apply.
- Once a design is commissioned, the client has ownership and may use the design for whatever purpose they desire.
- Clients may NOT claim to have designed the character and should always credit back to the Artist.
